Announced changes in the French capital gains tax system (English - French and Russian versions)

The French Budget Minister Bernard Cazeneuve has unveiled details of Government plans to reform the taxation of real estate capital gains in France, to give a much-needed boost to the country's stagnant housing market.

Due to apply from September 1, 2013, the Government's proposed reform will affect capital gains realized from the sale of real estate, other than a taxpayer's main residence and rented property.
 
  • The tax reductions allowed based on the holding period will be more progressive. Sellers will be granted total exemption from income tax on real estate capital gains after a 22-year holding period, instead of 30 years as is currently the case;
     
  • In addition, progressive reduction in social levies will apply also to social contributions (so called CSG/CRDS), and a total exemption from social contributions will be granted after a 30-year holding period;
     
  • To amplify the effect of this structural reform, and to provide an immediate surge to the property market, an exceptional additional tax reduction of 25 percent will be accorded for sales realized between September 1, 2013, and August 31, 2014.

Finally, the Government intends to abolish existing fiscal incentives encouraging constructible land retention, to boost the housing development market.

The Government aims to publish a fiscal instruction shortly, setting out the precise modalities of the planned tax reform. The proposals are to be integrated into the 2014 finance bill.


Réforme du régime d’imposition des plus-values immobilières

Bernard CAZENEUVE, ministre délégué chargé du Budget, a présenté jeudi 18 juillet devant les Sénateurs les modalités de cette réforme, qui sera applicable dès le 1er septembre 2013 pour les cessions d’immeubles actuellement imposables, à savoir les résidences autres que la résidence principale des contribuables et les logements mis en location.

La réforme repose sur plusieurs axes :
 
  • Pour fluidifier le marché immobilier et supprimer l’incitation fiscale à différer les cessions d’immeubles, les abattements pour durée de détention sont rendus plus réguliers. Le délai pour bénéficier d’une exonération totale de la plus-value au titre de l’impôt sur le revenu sera ramené de 30 à 22 ans ;
     
  • Dans le même objectif, l’exonération au titre des prélèvements sociaux (CSG et CRDS) interviendra désormais de manière progressive chaque année et sera totale au bout de 30 ans;
     
  • Pour amplifier cet effet et permettre un déblocage immédiat du marché immobilier, un abattement exceptionnel supplémentaire de 25% s’appliquera aux cessions réalisées entre le 1er septembre 2013 et le 31 août 2014.

En complément, conformément aux annonces du Président de la République, les abattements pour durée de détention sur les terrains à bâtir seront supprimés, ce qui réduira l’incitation à la rétention du foncier disponible pour la construction de logements.

Ces modalités seront détaillées dans une instruction rendue publique très rapidement. Elles seront intégrées au projet de loi de finances pour 2014.


Реформа налога на доход от прироста цены недвижимого имущества при ее перепродаже

18 июля министр, ответственный за подготовку бюджета Франции, Bernard CAZENEUVE  представил перед Сенатом страны конкретные условия применения данной реформы, которая вступит в действие с 01 сентября 2013 года и коснётся всех налогооблагаемых объектов недвижимости (за исключением недвижимости, которая является постоянным и основным местом проживания продавца).

Основные нововведения реформы следующие:
 
  • Срок владения недвижимым имуществом, после которого налог не взимается, будет сокращены с нынешних 30 лет до 22 лет. Ставки ежегодных вычетов, размер которых зависит от времени владения недвижимыми имуществом, будут пересмотрены в сторону их более равномерного распределения по годам владения недвижимостью;
     
  • Освобождение от уплаты социальных отчислений при перепродаже недвижимого имущества станет прогрессивным. При этом полное освобождение от выплаты социальных отчислений будет наступать по истечению 30 лет с момента покупки недвижимости;
     
  • Для того чтобы придать дополнительный стимул французскому рынку недвижимости и повысить предложение со стороны потенциальных продавцов, правительство предоставит дополнительный налоговой вычет в 25 %, который будет применяться к сделкам, которые будут иметь место с 01 сентября 2013 по 31 августа 2014.      
В дополнение к данным мерам ежегодные налоговые вычеты, которые применяются за давностью владения земельными площадками, предназначенными для застройки, будут ликвидированы с тем, чтобы стимулировать собственников на их скорейшую продажу для нужд возведения нового жилья. 

Конкретные условия применения вышеозначенных мер будут уточнены в специальной инструкции правительства, которая должна выйти в самое ближайшее время. Равным образом данные условия будут интегрированы в проект закона о финансах на 2014 год.
